J and R Visuals, LLC

By booking services with J and R Visuals, LLC, you agree to the following Terms & Conditions.

1. Scope of Services

J and R Visuals, LLC provides professional real estate visual marketing services, which may include:

  • Residential and commercial real estate photography

  • Real estate videography (vertical and horizontal formats)

  • Drone photography and/or videography (where legally permitted)

  • Social-media–ready content

  • Basic editing and formatting for MLS, web, and social platforms

Services do not include staging, cleaning, copywriting, listing management, or marketing strategy unless agreed to in writing.

Only services specifically listed in your booking confirmation are included.

2. Payment Terms

  • Full payment is required prior to the scheduled shoot unless otherwise agreed in writing.

  • Deliverables will not be released until payment is received in full.

  • Late payments may incur a 1.5% weekly late fee.

  • Client is responsible for any collection or legal fees incurred.

3. Cancellations & Rescheduling

Cancellations:

  • More than 7 days notice: Eligible for full refund.

  • Within 7 days: 50–100% of project fee may be charged.

  • Same-day cancellation or no-show: Full payment required.

Rescheduling:

  • One (1) reschedule permitted with at least 48 hours notice (subject to availability).

  • Additional reschedules may incur a fee.

  • Weather-related reschedules will be handled in good faith.

4. Client Responsibilities

The Client agrees to:

  • Ensure property is fully cleaned, staged, and photo-ready at the scheduled start time

  • Provide secure and lawful access (lockbox codes, keys, gate access)

  • Notify occupants of the scheduled shoot

  • Ensure utilities and lighting are operational

If the property is not photo-ready upon arrival, the shoot may be completed as-is or rescheduled at the full standard rate.

5. Re-Shoots

Re-shoots due to:

  • Property not being ready

  • Denied access

  • Occupant interference

  • Client-related delays

will be billed as a new shoot at the full rate.

6. Creative Control & Revisions

  • Artistic style, composition, and editing decisions are at the sole discretion of J and R Visuals, LLC.

  • One (1) round of minor revisions may be included (color/exposure adjustments only).

  • Revisions do not include re-shoots.

  • Additional edits may incur a fee.

7. Licensing & Usage Rights

J and R Visuals, LLC retains full copyright ownership of all content.

Clients receive a non-exclusive, non-transferable license for:

  • MLS listings

  • Social media

  • Website use

  • Internal business marketing

Prohibited without written permission:

  • Selling or sublicensing content

  • Heavy alterations beyond cropping/resizing

  • Paid advertising usage (unless licensed separately)

Extended licensing may be purchased.

8. Raw Files

Raw, unedited files are not included unless agreed to in writing.

If released, raw files remain the intellectual property of J and R Visuals, LLC.

9. Portfolio & Promotional Use

J and R Visuals, LLC reserves the right to use delivered content for portfolio, website, and promotional purposes unless otherwise agreed in writing.

10. Pets & Occupied Properties

  • Pets must be removed or securely contained prior to arrival.

  • J and R Visuals, LLC will not handle or restrain animals.

  • We are not responsible for pets appearing in images.

  • Removal of pets in post-production may incur additional fees.

Delays caused by occupants or pets may result in additional charges.

We reserve the right to leave a property if conditions are unsafe. In such cases, the shoot may be considered complete or require rebooking at full rate.

11. Weather Disclaimer

We are not responsible for:

  • Poor weather conditions

  • Exterior lighting limitations

  • Construction activity

  • Neighboring property issues

  • Parked vehicles or temporary obstructions

These do not qualify for refunds.

12. Limitation of Liability

Total liability is limited to the amount paid for the specific project.

We are not responsible for missed shots or limitations caused by:

  • Weather

  • Access issues

  • Property condition

  • Occupants

  • External disruptions

13. Force Majeure

Neither party shall be liable for failure to perform due to events beyond reasonable control, including natural disasters, illness, government restrictions, or emergencies.

14. Governing Law

This Agreement is governed by the laws of the Commonwealth of Pennsylvania.

15. Acceptance

Booking services with J and R Visuals, LLC constitutes acceptance of these Terms & Conditions.
